ScaryNet's Acceptable User Policy

AGREEMENT

This is a free PRIVATE NETWORK and your usage of it is a privilege we reserve the right to limit, regulate or terminate without notice and in any way we wish to.
Your use of this network signifies your complete acknowledgment and acceptance of these terms and conditions and any amendments, additions, or deletions which we may at our sole discretion choose to make. Said terms and conditions will be posted on this page from time to time as we see fit.
If you don't agree to any of our terms, your only recourse is to not to use our network If this is the case then you are hereby prohibited from our network and requested to DISCONNECT NOW.

By using our network you waive any claim or tort against us arising from your use of our network and hereby indemnify, save, and hold harmless from blame, ScaryNet and all persons affiliated with this network now, or in the future, and all their duly appointed representatives or agents. You agree that since usage of this network is offered free of charge, that it comes with ABSOLUTELY NO WARRANTY, and that we have made no representations nor received any inducement in consideration of any such warranty.

Don't do anything illegal or unethical on this network. (E.g., no 'flooding', 'Dong', ban-evading, kiddie-porn, 'cr4X0ring', personal or sexual harassment, slander or abusive behavior.) Moreover, don't bullyrag, harry, vex, beboth, nag, pester, provoke or feed after midnight the ops. They can be dangerous when annoyed.
The preceding list is not intended to be exhaustive and LAMENESS will be interpreted by our operators (the ops) as they see fit.
Please also respect any definitions as stated in the MOTD of the servers.

We do not harvest e-mail or IP addresses, for any commercial purpose and will appreciate your assistance in reporting and 'larting' spammers and 'data-miners'.
As a general policy we do not monitor or log any private conversations such as "/msg" or "/query". Please be aware that any participant or directed recipient of your communications may choose to log or not at their own discretion. HOWEVER, while we respect your privacy, we reserve the right to monitor or record any data transmitted to or from this network for reasonable cause such as imminent harm to any person, or the avoidance of undue legal liability on our part.
We reserve the right to cooperate fully with law enforcement or other government agencies or our ISP. In such cases we would normally require a warrant or a written request from 'the Man'. Notwithstanding, we also reserve the right to take any immediate measures we deem judicious to prevent or mitigate serious harm to any individual group or organization.

Furthermore, you acknowledge that we have made no representations as to censorship of or suitability and urbanity of any content transmitted through ScaryNet.Org whatsoever. You acknowledge that IRC by its very nature presents itself as a free and uncensored medium, and that any views or opinions expressed are not necessarily those of ScaryNet.Org, its agents or affiliates, but rather of the individuals presenting them.

Our failure to take action regarding any of the foregoing does not imply our approval of any LAMENESS; nor does it limit our right to later do so. We reserve the right to make, break and enforce our rules at our sole discretion. WE RULE!

The distribution of warez, mp3, pornographic material is tolerated on the network if the MOTD of the server you are connecting to doesn't specify otherwise.
Since the data itself is not heading through our network, but transferred using a direct client to client connection (DCC) ScaryNet is NOT responsible for these activities, we tolerate them, thats all.
However, should such a channel be the source of DDoS attacks against the network, then we reserve the right to request the channel to seek another network to operate on.
As noted earlier in this document: Child Pornographic distribution is NOT and will NEVER be allowed on this network. Should we detect any occurance of these activities, then we reserve the rights to report all sources to law enforcement agencies. You have been warned.

In the case of abuse or any violation of this policy, we reserve the right to forcibly remove you from our network. Should you insist on reconnecting to the network by the means of using other ip's, proxy's or other utilities that enable you to work a way around the ban we enforced upon you, then we reserve the right to contact any related authorities and or service providers used to report the committed abuse. Within this report we send, logs will also be included as proof. Any consequences resulting from this report you might suffer are your responsibility, not ours.

If any part of this agreement is held to be unenforceable, or in conflict with any law, or struck down by any court of competent jurisdiction as stated above, then the balance of the agreement shall remain in force and the agreement shall automatically be amended to reflect its original intent and purpose.
